Idaho State University assistant football coach DaVonte ‘Neal has been charged with first-degree murder in Arizona and the school intends to terminate his contract.

Neil has been charged with first-degree murder, a class-one felony, according to a copy of Neil’s indictment obtained Thursday evening by the Idaho State Journal. He also faces one count of drive by shooting, a class two felony, and one count of discharging a firearm into a structure, a class three felony.

The alleged incident took place on November 11, 2017 and the victim was Brian Burns, as the indictment shows.

A representative of the Maricopa County Sheriff’s Office in Burns with a gunshot wound in a vehicle near an overpass on Interstate 10 in Tempe, Arizona, according to an ABC 15 story. Burns was taken to the hospital with life-threatening injuries, the story goes, and died the next day.

Neil was indicted on May 16 by a grand jury in Maricopa County.

He is currently lodged in the Bannock County Jail and has no confinement awaiting extradition to Arizona.

Neil has been charged with first-degree murder, one count of drive-by-shooting, and one count of discharging a firearm into a structure in connection with the death of Brian T. Burns in 2017. The indictment did not provide any details about the circumstances under which the shooting took place.

Neal was indicted on May 16 by a grand jury in Maricopa County, which includes the Phoenix metropolitan area, and a warrant for his arrest was issued shortly after.

The Maricopa County Sheriff’s Office investigated the shooting, but spokeswoman Kahari Harrian said the agency was unable to release information about the case. The shooting took place in a busy commercial area along Interstate 10, about 8 miles (13 kilometers) south of Phoenix Sky Harbor International Airport.

Neil, who played college football at the University of Arizona, is being held at the Bannock County Jail in eastern Idaho City without bail awaiting extradition to Arizona.
